REFORMHER PILATES
Liability Waiver & Release Agreement
This Liability Waiver and Release Agreement (“Agreement”) is entered into by and between ReformHER Pilates (“Studio,” “Company,” “we,” or “us”) and the undersigned participant (“Client,” “Participant,” or “I”). By signing this Agreement, I acknowledge and agree to the following terms:
1. ACKNOWLEDGMENT OF RISKS
I understand that participation in Pilates classes, reformer Pilates, fitness instruction, stretching, strength training, mobility exercises, prenatal/postnatal exercise programs, and related activities involves inherent risks, including but not limited to: Muscle soreness, sprains and strains, slips, trips, or falls, aggravation of pre-existing injuries, equipment malfunction or misuse, dizziness or fainting, serious bodily injury, heart complications, permanent disability, or death. I voluntarily choose to participate in all activities offered by ReformHER Pilates and fully assume all risks associated with participation, whether known or unknown.
2. MEDICAL REPRESENTATION
I certify that: I am physically capable of participating in Pilates and fitness activities. I have consulted a physician if necessary regarding participation. I do not have any medical condition that would make participation unsafe. I understand it is my responsibility to inform the instructor of any injuries, pregnancy, surgeries, limitations, pain, discomfort, or medical concerns before participating. If I am pregnant, postpartum, or recovering from surgery or injury, I acknowledge that participation is entirely at my own risk.
3. RELEASE OF LIABILITY
In consideration for being allowed to participate in classes, sessions, workshops, events, or activities offered by ReformHER Pilates, I HEREBY WAIVE, RELEASE, DISCHARGE, AND HOLD HARMLESS: ReformHER Pilates, all owners, instructors, employees, independent contractors, volunteers, agents, and representatives, landlords, facility owners, partner gyms or facilities, and equipment manufacturers FROM ANY AND ALL CLAIMS, LIABILITIES, DEMANDS, CAUSES OF ACTION, DAMAGES, COSTS, OR EXPENSES ARISING OUT OF OR RELATED TO PERSONAL INJURY, ILLNESS, PROPERTY DAMAGE, NEGLIGENCE, EQUIPMENT FAILURE, ACCIDENTS, LOSSES, OR DEATH arising from or connected to my participation in any ReformHER Pilates activity, whether occurring on-site, off-site, online, virtually, or through recorded instruction. THIS RELEASE INCLUDES CLAIMS BASED ON ORDINARY NEGLIGENCE OF THE STUDIO TO THE FULLEST EXTENT PERMITTED BY KANSAS LAW. THIS RELEASE DOES NOT APPLY TO GROSS NEGLIGENCE OR WILLFUL AND WANTON MISCONDUCT BY THE STUDIO.
4. ASSUMPTION OF RESPONSIBILITY
I understand that I am solely responsible for: Monitoring my own physical condition, exercising within my personal limits, stopping activity if I experience pain, dizziness, discomfort, or medical symptoms, and using equipment properly and following instructor directions. I acknowledge that no guarantees have been made regarding fitness results, physical improvements, weight loss, rehabilitation, or outcomes.
5. EQUIPMENT USE
I understand that Pilates equipment, including reformers, springs, straps, boxes, jump boards, resistance equipment, weights, mats, and other apparatus may cause injury if improperly used. I agree to use all equipment carefully and as instructed. I assume full responsibility for any injury or damage resulting from misuse of equipment.
6. PREGNANCY & POSTPARTUM ACKNOWLEDGMENT
If participating while pregnant or postpartum, I acknowledge that exercise during pregnancy and postpartum recovery carries additional risks. I have received medical clearance if applicable. I voluntarily participate despite these risks. I release ReformHER Pilates from any claims relating to prenatal or postpartum participation.
7. PERSONAL PROPERTY & REFUNDS
ReformHER Pilates is not responsible for lost, stolen, or damaged personal belongings. I understand that purchases, memberships, packages, sessions, workshops, and classes may be subject to separate cancellation and refund policies established by ReformHER Pilates.
8. INDEMNIFICATION & GOVERNING LAW
I agree to indemnify and hold harmless ReformHER Pilates from any claims, liabilities, damages, costs, or legal fees arising from my participation or violation of this Agreement. This Agreement shall be governed by and interpreted in accordance with the laws of the State of Kansas.
9. CLASS EXPERIENCE CREDITS
Class Experience credits are valid for thirty (30) days from the date of purchase. Unused credits will expire automatically after 30 days and are non-refundable, non-transferable, and cannot be extended. Credits may only be used to book available classes during the active 30-day window. Expired credits hold no monetary value and cannot be reinstated.
10. CANCELLATION & NO-SHOW POLICY
All class reservations must be cancelled at least twenty-four (24) hours prior to the scheduled class start time. Cancellations made less than 24 hours before class will result in forfeiture of the credit or payment used to book the class. No-shows will also result in credit forfeiture. Membership holders who cancel less than 24 hours before class or fail to attend may be subject to booking restrictions at the Studio's discretion. No refunds will be issued for late cancellations or no-shows.
